On December 26, 2022, the Stanovlyansky District Court of the Lipetsk Region issued a decision granting our client's demands for recognition of the right to lease, obligation to remove obstacles in the use of the land plot, and collection of astreinte in case of non-compliance with the court's decision.
On December 26, 2022, the Stanovlyansky District Court of the Lipetsk Region issued a decision granting our client's demands for recognition of the right to lease, obligation to remove obstacles in the use of the land plot, and collection of astreinte in case of non-compliance with the court's decision.
One of the key issues was the contents of the postal mailing. The opponents' position was based on the fact that the letter contained a notice of termination of the lease agreement, but no inventory of attachments to the letter was made upon sending. The plaintiff did not deny receiving the letter but referred to receiving another document.
The decision to satisfy the claim is an important example of fair burden of proof distribution: since the recipient did not control the sending and did not evade receiving the letter, he should not bear the risk of not making an inventory or proving the negative fact of not receiving a certain document.

#TEAMThe government plans to retain the simplified regime of redomiciliation of companies from abroad to special administrative regions (SARs) in 2023.
A draft law has been prepared, extending the current exemptions - the possibility of redomiciliation of newly established companies, increased time limits for meeting the basic requirements for the company, the suspension of inspections and a number of others.

#TEAMThe new Decree of the Russian President of 27.05.2022 № 322 established a special order of payments in favor of some categories of right holders on the obligations in the sphere of intellectual property.
The Decree is largely similar to the previously introduced procedure with the use of type “C” accounts and provides for the transfer of funds for the use of intellectual property in Russian rubles to a special type “O” account opened in the name of the right holder. The withdrawal of funds from the type "O" account to another account of the right holder is allowed only with the permission of the Government Commission.
The rights holders to whom payments must be made under a special procedure include those from unfriendly countries and companies under their control, as well as rights holders who advocated the imposition of sanctions on Russia, rights holders who have terminated, suspended or substantially curtailed their activities in Russia, and rights holders brought to administrative responsibility for discrediting the Russian armed forces or contempt of state power or criminal responsibility for spreading fakes about the actions of the Russian army.
